The Office of the Inspector General recently released their report: Hospice Deficiencies Pose Risks to Medicare Beneficiaries OIG Report

There is a lot to learn in the OIG report. However, an often overlooked aspect of deficiencies and corporate compliance are managing HR tasks.

In APPENDIX A of the report we have a list of conditions of participation for the Medicare Hospice Program. 2 of the conditions are directly related to professional qualifications.

CFR (Code of Federal Regulations) Citation:

§418.62 – Licensed Professional Services – Described as: Licensed professional services provided directly or under arrangement must be authorized, delivered, and supervised only by healthcare professionals who meet the appropriate qualifications.

§418.114 – Personnel Qualifications – Professionals who furnish services directly, under an individual contract, or under arrangements with a hospice, must be legally authorized (licensed, certified or registered) in accordance with applicable Federal, State and local laws, and must act only within the scope of his or her State license, or State certification, or registration. All personnel qualifications must be kept current at all times.

Furthermore, the CMS Top Ten Hospice Survey Deficiencies Compliance Tip Sheet lists under §418.114 – professional Qualifications, the specific deficiency of criminal background checks on top of ensuring professional qualifications and maintaining a record of those qualifications being current.

Hospice HR pros often have their own makeshift system comprised of multiple folders, spreadsheets, calendars, and a good memory. Alternatively, many agencies, recognizing the risk these requirements pose eat the significant expense of yet another expensive & cumbersome software system to maintain clean organized records of employee professional qualifications.
